Ordella Seller Listing Agreement

Version: 2026-07-11.1
Status: DRAFT — for legal review only

This Seller Listing Agreement ("Seller Agreement") supplements the Ordella Terms of Service when you submit an object for auction. Capitalised terms not defined here have the meaning in the Terms.

By attesting and publishing a lot, you agree to this Seller Agreement for that lot and generally for your seller activity on Ordella.

1. Your submission

1.1 You submit photographs of the actual object you intend to sell, and optionally a short note of facts the house cannot see.

1.2 You warrant that you have the legal right to sell the object and that the object is not prohibited on Ordella.

1.3 You must not submit stock photos, another person's photographs, or images that materially misrepresent the object.

2. The house creates the listing

2.1 Ordella (including AI-assisted tools) may identify, describe, classify, and price the object.

2.2 You will receive a draft listing with claims marked by provenance (observed, declared, inferred, verified).

2.3 You must read the draft before publication. You may correct factual errors, challenge the opening price within house limits, or withdraw.

2.4 You may not add promotional language, unrelated keywords, or unverifiable claims.

3. Your attestation (binding)

When you select Attest & Publish, you confirm that:

(a) the photographs depict the actual object offered for sale;

(b) your declarations and answers (including confirmations of AI suggestions) are accurate to the best of your knowledge;

(c) you have disclosed material defects, alterations, and legal encumbrances known to you, even if not visible in the photographs;

(d) you accept the opening price shown (or the house-adjusted maximum) and understand that one valid bid creates a binding sale with no hidden reserve;

(e) you have read and agree to this Seller Agreement and the Terms of Service.

This attestation is deliberate confirmation, not casual typing. We log the listing version, your attestation, and timestamp as evidence.

4. AI suggestions and one-tap confirmations

4.1 When you confirm an AI suggestion (e.g. "Confirm: hem probably altered — yes"), you attest that the suggestion is correct. If it is incorrect, responsibility may remain with you to the extent the error was within your knowledge.

4.2 We record: the AI inference, the suggestion shown, your confirmation, and the time.

5. Your responsibilities after sale

5.1 You will pack and dispatch (or make available for collection) as instructed, within stated deadlines.

5.2 You will provide shipping evidence when required (e.g. packing photograph, label).

5.3 You will respond only to legitimate questions forwarded by Ordella; you are not required to answer questions already covered in the listing.

6. Liability

6.1 You are primarily liable for:

  • inaccurate declarations and attestations;
  • material defects known to you but not fairly disclosed;
  • sending an object that materially differs from the approved listing and submitted photographs;
  • failure to dispatch or serious shipping negligence.

6.2 You are not liable for:

  • fair inferred wording that was not presented as certainty, where you disclosed relevant facts;
  • platform errors introduced after your approval without your consent (Ordella remains responsible).

6.3 Ordella may charge fees, withhold payouts, or restrict your account for breach.

7. Withdrawal before publication

You may withdraw before attestation without publishing. Review fees may still apply as disclosed at submission.
